Florida Real Estate Law

Real Estate Lawyer in Florida

Real estate matters can become quite complex. Even the simple sale of a private home can go terribly wrong if proper steps are not taken to protect the seller and/or buyer. That is why it is important to have lawyer review any contracts to insure you truly understand what you are signing and the possible ramifications of the same. Even when sales do go through correctly, more and more homes are ending up in foreclosure as a result of rising interest rates and a slowing economy.

Foreclosures

Foreclosure is the legal process where the holder of the note usually accelerates the payments due for being delinquent in the buyer's monthly payments, and seeks relief from the court to essentially evict the buyer and regain possession of the property. Ultimately, the property will end up in a public auction, which as you can imagine, generally results in a sale for less than the fair market value of the house. How long have you been in your house? How much equity do you have built up in your house? Are you able to sale your house? If so, for how much and how long will it take? Do you otherwise have good credit? These are only some of the questions we need to address in a foreclosure procedure to recommend what is the best approach to seek. At its best time, the foreclosure proceeding will take six-nine months. At its worst, much longer. Time is of the essence to save the equity in your house and credit. If you are involved in a foreclosure and need legal advice, call my office today for a free consultation.

 Evictions

The eviction process is the legal process of how a land lord rightfully regains possession of his or her property after a default by the tenant.  You simply cannot go out and change the locks when the tenant goes to work or leaves for dinner.  While it can be a timely process, most evictions can be finalized in a timely manner of 30-60 days, even if the tenant objects to the same.  Harvey Law, LLC has been representing land lords in the eviction process for the last seven (7) years.  As a land lord himself, Mr. Harvey understands the importance of a timely eviction process.  Call today for a free consultation.
